GENERAL CONDITIONS
1. All prices and all costs within the website will be expressed in Lei and will include VAT (19%).
The website www.mallevo.ro, hereinafter called Mallevo, is the property of Active Mallevo SRL, registered in Bucharest, Sos. Colentina, no. 16., Sector 3, Bucharest registered at the Trade Register under number J40/7278/18.04.2022, CUI 45976175, hereinafter called Active Mallevo SRL. Using this site implies acceptance of the terms and conditions below. We recommend reading them carefully. Active Mallevo SRL assumes the right to modify these provisions without further notification. The latest version can be found by accessing this page, called "Terms and conditions".
Active Mallevo SRL guarantees the user limited access, in personal interest (making online orders, information), to the Mallevo website and does not grant him the right to download or modify the website in whole or in part, to reproduce in whole or in part the site, to copy, sell/resell or exploit the site in any other way, for commercial purposes or contrary to the interests of Active Mallevo SRL without its prior written consent. The right to create a web link - link - to Mallevo is limited, non-exclusive and revocable, and it is granted as long as it does not cause shortcomings of any kind for Active Mallevo SRL. or to any of our partners, only after obtaining our agreement in writing or by email. 1. Active Mallevo SRL copyright on the information published on the website The entire content of the Active Mallevo SRL website - images, texts, graphics, symbols, web graphic elements, emails, scripts, programs and other data - is the property of Active Mallevo SRL and its suppliers and is protected by the Law for the protection of copyright (law no. 8/1996) and the laws on intellectual and industrial property. The use without the consent of Active Mallevo SRL of any of the elements listed above is punishable according to the legislation in force. It is allowed to use the Mallevo website only within the limits mentioned in this document.
2. The products and services offered by Active Mallevo SRL on the Mallevo website, pricing policy Active Mallevo SRL reserves the right to select its customers. The products sold through Mallevo are new, in the original packaging of the manufacturer and at the time of delivery are accompanied by the tax invoice, according to the legislation in force. The products and services are offered in compliance with the provisions of this document and within the limits of the available stock. For this reason, Active Mallevo SRL assumes the right not to honor a certain order if the respective product is no longer in stock or is no longer found in the importer's current offer. The prices are updated periodically, depending on the BNR exchange rate. The purchase price printed on the invoice will be the same as that established by the Active Mallevo SRL sales consultant at the time
confirmation of the order as a firm order, or, in the case of orders with online payment directly by credit card, this price will be the one published on the website at the time of purchase.
Active Mallevo SRL guarantees the good functioning of this site, the quality of the information presented, the correctness of the descriptions, the updating of the content, the quality of the products on the site. The images published on the site are real images of the products sold. The Mallevo content (texts, product descriptions, technical specifications, images, symbols) is created in collaboration with the representatives of the respective manufacturers in our country. For this reason, Active Mallevo SRL does not assume responsibility for the descriptions and specifications of the products displayed on the Mallevo website, these being also made available to us by the representatives of each brand, or by the importers approved by them. Active Mallevo SRL and its partners reserve the right to modify product descriptions and specifications without prior notification.
3. Payment of products Payment for products ordered from the Mallevo website according to these "Terms and Conditions" can be made in advance or upon delivery of the products. Active Mallevo SRL reserves the right to request payment of products in advance in certain cases. Advance payment can be made by payment order or by credit card; proof of payment must be sent to Active Mallevo SRL at the e-mail address office@mallevo.ro . The delivery will be made only after receiving the payment confirmation. Payment in advance is also considered payment with the help of the online credit card. In this case, Active Mallevo SRL. will request the electronic payment processor to confirm the security and validity of the transaction, and will carry out additional checks where necessary, before the delivery of the products, this check may even lead to the cancellation of the respective order for security reasons.
4. Delivery of the products The delivery of the products will be made anywhere in the country. Active Mallevo SRL reserves the right to confirm orders before honoring them by contacting customers. The products are delivered within 24-48 hours from the date of order confirmation for products in stock and 10 working days for pre-orders.
If the customer is not found at the mentioned address, within the time interval established by mutual agreement, our courier will return once more after managing to contact him, after which the order will be canceled and the product returned to the office.. Reception of the products represents the customer's acceptance that the products have arrived in good condition and correspond quantitatively and qualitatively to what was ordered and this is done at the time of signing the legal tax documents that accompany the package. The invoice constitutes a sale/purchase contract according to the Romanian legislation in force. The customer expresses his explicit agreement when signing the invoice regarding the fact that he received the products that are in accordance with the order and his needs. Active Mallevo SRL reserves the right to delay or cancel deliveries of ordered products if they cannot be honored for reasons independent of Active Mallevo SRL, which include: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, riots, civil disturbances or other force majeure impediments according to Romanian law.
The maximum amount of damages that can be paid by Active Mallevo SRL to any customer in case of non-delivery or improper delivery is the amount collected by Active Mallevo SRL from this customer.
5. Promotions and contests Active Mallevo SRL establishes the regulations of the promotions and contests it organizes. These regulations are made known to potential participants only through their own website. Only orders that strictly comply with the rules displayed on the website benefit from these promotions. Also, the promotions only apply to orders that are registered by the company during the time period specified in the regulation and in which the promotion is valid and only within the limit of the available stock. We do not guarantee the stock availability of the products for the promotion and we can interrupt or cancel it at any time without any prior notification.
6. Product warranty The warranty conditions are in accordance with Law 449/2003 and OG 21/1992. When requesting the guarantee, it is necessary to present the defective product in the original packaging, together with the related accessories, a copy of the tax invoice and the original guarantee certificate. If the products arrive unaccompanied by these documents, the products can be returned to the applicant/shipper without voiding the warranty.
The warranty offered for the products presented on the website is 30 days.
All products are accompanied by the original warranty certificate. The maximum amount of damages that can be paid by Active Mallevo SRL to any customer in case of non-delivery or improper delivery is the amount collected by Active Mallevo SRL from this customer. 6. The right to return the purchased products The customer can unilaterally terminate the contract (online purchase) without penalties and without invoking a specific reason within 14 working days of receiving the products, cf. ord. 130/2000 supplemented by law 51/2003 regarding the legal regime of distance contracts, only in writing, and can return the product(s) within the same period of 15 working days.
The return of the products will be done at the customer's expense. Active Mallevo SRL will refund the value of the order in no more than 14 calendar days from the date of written termination of the contract. The returned amount as well as the return conditions do not include transport costs.
The law also provides the following details: "The consumer cannot unilaterally denounce contracts for the supply of products executed according to the consumer's specifications or distinctly personalized products, as well as those that, by their nature, cannot be returned or that can degrade or quickly deteriorate".
7. User comments on the Mallevo website.
Users who access the website www.mallevo.ro can make comments on the products offered, which can be published on the website after prior approval. Active Mallevo SRL reserves the right, but not the obligation, not to publish comments on the site with illegal, obscene, threatening, defamatory content, which in any way disturbs the private life of other people, violates intellectual property rights, contains viruses, texts representing mass emails or any other form of spam. Active Mallevo SRL will not bear the responsibility and will not be able to be obliged in any way
of compensation for any kind of damage caused by such comments or electronic communications, they being offered under the same limitation of responsibility as the rest of the content on the website, according to the articles in this document. In the case of sending information, other than those related to the process of buying/selling products, it is considered that the user grants to Active Mallevo SRL and its partners the non-exclusive, unlimited, free, irrevocable and retransmissible right to use, reproduce, modify, adapt, publish, translate, as well as the right to distribute it by any means. The user guarantees that he has all the rights to the content he transmits in any way to be published on the site or not, so that, by using this content, he does not cause damage to another person.
8. Quality of hosting services, links to other websites, malfunctions The Mallevo website is hosted by the servers of a third company. Active Mallevo SRL cannot be held responsible for any errors that may appear on the site, regardless of the reasons for their occurrence, including changes to the site, settings, or updates to the programmed scripts. Active Mallevo SRL cannot be held responsible for errors that occur due to the use of certain browsers to visit the Mallevo website. Active Mallevo SRL. is not responsible for the content, quality or nature of the sites reached through links from the Mallevo site. For the respective sites, full responsibility is borne by the owners of the sites in question.
9. Subscribing and unsubscribing to the newsletter Subscribing and unsubscribing to the Mallevo website newsletter is free and voluntary, and implies acceptance of the following terms of use. The messages sent are not unsolicited and you can unsubscribe at any time by following the instructions in the footer and header of each email. The messages sent comply with the Electronic Commerce law regarding commercial communication as stipulated by Romanian and international legislation. The use of the newsletter is done under the same conditions of limitation of liability from the point of view of the content as the use of the website is authorized, under the conditions provided by this document, and the confidentiality policy is described in detail in the next section. Active Mallevo SRL holds all rights to the content of the newsletter sent to subscribers under the same conditions as for the information published on the website, in accordance with the provisions of this document. Subscribers of the Mallevo newsletter can resend these commercial communications to other people, at their own risk, and under the conditions that they have not modified either the structure or the content of the respective messages. The persons who received the commercial messages from the subscribers of the Mallevo newsletter are considered to have been informed in advance by the subscribers about the provisions of this article. In this context, Active Mallevo SRL cannot be held responsible in any way for the actions of its subscribers. Active Mallevo SRL reserves the right to restrict the access of any subscriber to the newsletter, if Active Mallevo SRL has any reason to believe that the respective subscriber does not comply with the provisions of this document.
10. Confidentiality policy Active Mallevo SRL guarantees the security and confidentiality of the data hosted and transmitted through its computer system. This information can be used by Active Mallevo
SRL to send the user order confirmation, various special offers, promotions, etc. only with the prior consent of the client. The provision of personal data to Active Mallevo SRL does not imply obligation on the part of the users and they can refuse to provide this data in any circumstances and can request their deletion from the database free of charge. Any such request/notification in order to delete them from the database, will be dated, signed and sent by the person registered in the database by e-mail to the address office@mallevo.ro Due to the way in which the personal data stored by the Mallevo system are transmitted electronically, Active Mallevo SRL cannot be held responsible in any way for their loss or the copying of information by unauthorized persons, through the use of interception equipment or software . When notified by users, Active Mallevo SRL will take all measures and provide all necessary files to the competent bodies empowered to solve this type of crime. The information provided to Active Mallevo SRL is used only for the purpose for which it was entered (making orders, sending messages to Active Mallevo SRL staff, subscribing to the newsletter, etc.), according to the laws in force. Active Mallevo SRL does not provide your e-mail address to third parties, does not encourage spam, and does not make public the data provided by its clients without their explicit consent.
Active Mallevo SRL certifies that it will respect the rights conferred by Law no. 677/2001 regarding the protection of individuals regarding the processing of personal data and the free movement of such data, of Law no. 365/2002 regarding electronic commerce, as well as Ordinance no. 130/2000 regarding consumer protection when concluding and executing distance contracts with subsequent amendments. These rights include (the list is not exhaustive):
- The right to ask Active Mallevo SRL to confirm the processing or not of your personal data, free of charge;
- The right to ask Active Mallevo SRL to rectify, update, block or delete, free of charge, those data provided whose processing is not in accordance with the provisions of Law no. 677/2001;
- The right to ask Active Mallevo SRL to stop, free of charge, the processing of your personal data;
- The right to ask Active Mallevo SRL to stop sending promotional messages.
Any such request/notification will be given, signed and sent by the person registered in the database by e-mail to the address office@mallevo.ro . Mallevo uses security measures against the loss, alteration or misuse of information under our control.
Active Mallevo SRL cannot be held responsible for errors caused by the user's negligence regarding the security and confidentiality of his account and password.
11. Final provisions Any other problem caused by the products and services presented on Mallevo and which is not already dealt with by any article in this document, will be resolved amicably within 30 working days from the date of the written notification of the problems , by the user.
In the event that the problem encountered is not resolved within a reasonable time (within
the maximum period of 30 days), or in a satisfactory way, please contact for an amicable conciliation at the email address office@mallevo.ro
In the event that the conflict was not resolved amicably, the competence rests with the Romanian courts or an alternative dispute resolution body, agreed by both parties. By agreeing to these Terms and Conditions of Use of the Mallevo website, the customer fully assumes the consequences arising from the use of the website under these conditions.
We also reserve the right to cancel any order if the recipient does not respond to the contact number provided in the order within 2 working days, or if he cannot be found at the address, date and time established and confirmed prior to delivery .
